If you had asked me last year if I would have hosted such events or been able to share all this information and resources with you…I would have said that’s not where I see myself…but here we all are!

OSHA made what rule?
Let’s recap first – “Roman & Civil Law. A written command given by a principal to an agent; specif., a commission or contract by which one-person (the mandator – *so like a governor) requests someone (the mandatary – *so like you and me) to perform some service gratuitously, the commission becoming effective when the mandatary agrees.”
A “mandate”, a “rule”, is not legally binding unless you gratuitously accept it.
OSHA cannot make a law – OSHA can only regulate established laws.
Let me share with you the GREAT news about OSHA!

OSHA has shared with everyone a “Mandatory Vaccination Policy Template”. Let’s point out that no policy can be mandatory – double speak in the headline! Remember, your employer cannot make you come to work naked every day, they cannot make you inject yourself with poison to stay awake work – this is not different. They cannot make you inject anything into your body that you do not want to. And OSHA CONFIRMS THIS!
OPEN OSHA covid-19-ets2-sample-mandatory-vaccination-policy – and read with me.
Page 2, Second Paragraph – “Employees may request an exception from this mandatory vaccination policy if the vaccine is medically contraindicated for them or medical necessity requires a delay in vaccination. Employees also may be legally entitled to a reasonable accommodation if they cannot be vaccinated and/or wear a face covering (as otherwise required by this policy) because of a disability, or if the provisions in this policy for vaccination, and/or testing for COVID-19, and/or wearing a face covering conflict with a sincerely held religious belief, practice, or observance. Requests for exceptions and reasonable accommodations must be initiated by [insert relevant instructions]. All such requests will be handled in accordance with applicable laws and regulations.”
OSHA confirms exemptions must be accommodated.
Now take a look at the footnote on page 7 – “This model plan is intended to provide information about OSHA’s COVID-19 Emergency Temporary Standard. The Occupational Safety and Health Act requires employers to comply with safety and health standards promulgated by OSHA or by a state with an OSHA-approved state plan. However, this model plan is not itself a standard or regulation, and it creates no new legal obligations.”
BOOM!
Your employer does not have to comply and you cannot be forced to comply!
Further, the United States Court of Appeals for the Fifth Circuit had this to say – “But health agencies do not make housing policy, and occupational safety administrations do not make health policy. Cf. Ala. Ass’n of Realtors, 141 S. Ct. at 2488–90. In seeking to do so here, OSHA runs afoul of the statute from which it draws its power and, likely, violates the constitutional structure that safeguards our collective liberty” and “In addition, IT IS FURTHER ORDERED that OSHA take no steps to implement or enforce the Mandate until further court order“. Fifth Circuit Court – 11/12/2021
This means they cannot regulate or fine any entity until it goes to the Supreme Court.
