On March 25, 2022 we saw the Supreme Court side with the Navy with Kavanaugh stating that the courts should not second-guess military officials and that “I see no basis in this case for employing the judicial power in the manner that military commanders believe would impair the military of the united states as it defends the American people”.
Once again Kavanaugh sides with the liberals and fails to defend religious freedoms.
Alito and Gorsuch dissent with Alito, citing Ramirez v. Collier, 595 U.S., stating “We properly went to some lengths to protect Ramirez’s rights because that is what the law demands. We should do no less for respondents”.
He also provided “Indeed, the District Court found that under Navy policy those participating in clinical trials and those with medical contraindications and allergies to vaccines remained deployable, unlike those seeking religious accommodations”.
Following this decision, Reed O’Connor – Texas District Judge – issued an order granting ‘class action’ status to the Navy Seals who are suing the Secretary of Defense.
Reed stated “The Navy’s interest in vaccinating the remaining 0.6% of its personnel—or less—does not outweigh the harm Plaintiffs are facing as they try to exercise their constitutional rights”.
The Supreme Court is not the pinnacle of Constitutional interpretation so who put them there? Who made the federal courts king???
Well, the Supreme Court itself put themselves in power.
Their job is to place checks and balances on legislative and executive power. They made themselves the sole authority to declare an act unconstitutional or constitutional. If we think that the Supreme Court is the power, then we have opened the door to tyranny.
The People of the States have the power. The People of the States are the ‘kings’.
